TRIBES Terms of Service

1. General Information and Acceptance

These Terms of Service govern access to and use of TRIBES, a gamified social discovery and community-perception service. TRIBES allows adults to view profiles, categorize other users into community "Tribes", receive community-perception results, send limited "Flames", and form matches when Flames are mutual. TRIBES does not currently provide in-app direct messaging between users. The only chat is an optional chat with AI-generated profiles in Practice.

By creating an account or using TRIBES, you agree to these Terms. If you do not agree, you must not use TRIBES. Our Privacy Policy at https://tribes-app.net/privacy explains how personal data is handled. Accepting these Terms does not replace any separate consent required for data processing.

In these Terms, "we", "us" and "our" refer to Neu Outsource UG (haftungsbeschränkt) & Co. KG.

3. Eligibility and Accounts

You must be at least 18 years old to create or use a TRIBES account. We require a birthdate and check age eligibility using the date you provide. You must provide a truthful birthdate and must not use the service if you are under 18.

TRIBES currently uses Google or Apple authentication. TRIBES does not maintain its own account password. Your ability to access TRIBES may therefore depend on continued access to the Google or Apple account used to sign in.

You must not impersonate another person, create a deliberately misleading profile, access another person's account without authorization, or use another person's identity or photos without permission.

You are responsible for activity carried out through your account to the extent reasonably within your control. If you believe your account or authentication provider has been compromised, contact support@tribes-app.net and take appropriate steps with the relevant authentication provider.

4. The TRIBES Service

TRIBES is built around community perception and social discovery. Users privately select Tribes for themselves and may categorize other profiles based on their own perception. Community results are derived from those categorizations. A categorization is a user opinion, not a verified statement about another person's identity, orientation, personality, body, background, or other characteristic. Users can see who categorized them. The Tribes each person selects are not shown to the categorized user individually. They appear only in combined Community results and, when two users match, each can see the Tribes the other selected for them.

Users may send limited Flames to signal interest. When two users send Flames to one another, TRIBES creates a match. A matched user may then be able to see optional external social handles provided by the other matched user. Any communication that follows through Instagram, Facebook, Telegram, ROMEO, SCRUFF, or another external service occurs outside TRIBES and is subject to that service's own terms and controls.

Practice mode and Spot the Tribe contain labelled AI-generated profiles rather than real people. Practice Flames are free and do not create real matches or contact a person.

In Practice, you can chat with an AI-generated profile. Its replies are created automatically by an AI service and may be inaccurate, incomplete or unexpected. They do not represent the views of TRIBES or of any real person. A chat has a limited number of messages. Do not share personal or sensitive information in the chat.

You can share a Tribe Guess Challenge about an AI-generated profile you read in Practice. Anyone with the link can play it without an account. Challenges are available for 7 days and can only be made from AI-generated profiles, never from real users.

5. Profile Content and Photos

You retain ownership of photos and other content that you provide to TRIBES. To operate the service, you grant Neu Outsource UG (haftungsbeschränkt) & Co. KG a non-exclusive license, for as long as the content is needed for your account or as otherwise permitted by applicable law, to host, store, reproduce, process, transmit, and display that content only as reasonably necessary to provide, secure, maintain, and technically improve TRIBES.

• You may upload only photos that you own or are authorized to use and display.
• You must not upload photos of children, nude or sexually explicit photos, or another person's photo without that person's permission.
• You must not use profile content to impersonate another person, mislead users about who you are, or expose another person's private or sensitive information without authorization.
• We may remove or restrict access to content where reasonably necessary for safety, legal compliance, enforcement of these Terms, or operation of the service. The handling of personal data and deletion requests is described in the TRIBES Privacy Policy.

6. Community Rules and Acceptable Use

TRIBES is intended to support respectful social discovery. You must not use the service to:

• harass, threaten, intimidate, stalk, shame, or deliberately abuse another user;
• upload prohibited profile photos, including nude or explicit images or images involving minors, or create, share, promote or facilitate child sexual abuse or exploitation, including grooming or child sexual abuse material;
• create fake or impersonating profiles, use another person's photos without permission, or materially misrepresent your identity for deceptive purposes;
• circumvent blocks, reporting tools, account restrictions, age controls, or other safety measures;
• scrape, harvest, copy, publish, or systematically collect user profiles, photos, categorizations, social handles, or other user information without authorization;
• attempt to identify, expose, threaten, or misuse another person on the basis of information or inferences obtained through TRIBES;
• interfere with the normal operation or security of TRIBES, including through automated abuse, malicious code, unauthorized access, or attempts to exploit technical weaknesses;
• use the AI chat to try to produce unlawful, sexual, hateful or harmful content, or to get around its limits;
• send challenge links as spam or in a way that harasses others; or
• use TRIBES in violation of applicable law or for conduct that creates a material safety risk to other users.

7. Flames, Matches, Tasks and Gamification

Flames, stars, experience points, levels and other task-related rewards are service features intended to support the TRIBES interaction model. They are not money, stored value, cryptocurrency, property, or a financial instrument and cannot be redeemed for cash. TRIBES does not currently offer payments, subscriptions, or in-app purchases. Stars can be exchanged for Flames inside TRIBES only.

Flame availability, task requirements, reward state, matching behavior, and other gamified features may be adjusted as the service develops. We do not guarantee that you will receive Flames, categorizations, a match, a particular Community result, or a response from another user.

8. Blocking, Reporting and Moderation

You may use blocking tools to exclude another user from your Feed, Readers, Flames and Matches experiences and prevent Flame interactions. Blocking does not remove copies of information another person has already obtained or control contact on external services.

You may report a profile or conduct through the in-app reporting tools, including suspected underage accounts or child sexual abuse or exploitation. Reports may include a reason, optional description, and reference information relating to the reported profile or photo. You can also send safety concerns or complaints about a moderation decision to support@tribes-app.net.

We review reports through authorized moderators and may remove photos or restrict content or account access where necessary for safety, legal compliance, service integrity, or enforcement of these Terms. Illegal child sexual abuse material must be removed when identified and reported to the appropriate authorities where required by law. We cannot promise a particular outcome.

Misuse of reporting or blocking tools, including knowingly false or abusive reports intended to harass another user, may itself be treated as a violation of these Terms.

9. External Services and Off-Platform Contact

We use third-party services for functions such as authentication, notifications, country lookup, AI chat replies, and technical operation as described in the Privacy Policy. Where you choose to open or use an external social platform through a matched user's social handle, your use of that platform is governed by the third party's terms and privacy practices.

We do not control conversations, meetings, transactions, or other activity that users choose to conduct outside the service. Users are responsible for deciding whether and how to communicate with or meet another person off-platform and should use appropriate judgment and safety precautions.

10. TRIBES Intellectual Property and License to Use the Service

TRIBES software, interface elements, branding, graphics, documentation, and other materials supplied by Neu Outsource UG (haftungsbeschränkt) & Co. KG, excluding user-provided content, are owned by or licensed to Neu Outsource UG (haftungsbeschränkt) & Co. KG and are protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable right to access and use TRIBES for its intended purpose.

You may not copy, sell, sublicense, commercially exploit, reverse engineer, or create unauthorized derivative versions of TRIBES except to the extent such restriction is prohibited by applicable law. Use through an app store may also be subject to the applicable platform terms.

11. Testing, Availability and Changes to the Service

TRIBES may be offered in testing, beta, pre-release, or production form. Testing versions may contain incomplete features, temporary limitations, errors, or features that change before public release.

We may modify, add, remove, suspend, or discontinue features where reasonably necessary for security, legal compliance, safety, technical operation, or product development, subject to applicable consumer rights and any required notice or termination rights.

We do not guarantee uninterrupted availability or that every feature will remain unchanged. Where a material change affects these Terms or users' legal rights, notice will be provided as required by applicable law.

12. Account Restriction, Termination and Deletion

You may stop using TRIBES at any time. You can remove profile photos and unlink optional social handles, or delete your account through Settings → Delete Profile. You can also request account deletion by emailing privacy@tribes-app.net. Instructions, identity-verification information and retained-data exceptions are described at https://tribes-app.net/privacy#account-deletion. Deleting your TRIBES account does not delete your Google, Apple or other external accounts.

Neu Outsource UG (haftungsbeschränkt) & Co. KG may restrict, suspend, or terminate access where reasonably necessary because of a serious or repeated violation of these Terms, fraudulent or abusive conduct, a safety or security risk, unlawful conduct, misuse of the service, or a legal requirement. Where appropriate and legally required, we will take account of the circumstances and any applicable notice or appeal requirements.

13. Disclaimers and Responsibility

TRIBES provides a social discovery and community-perception service. Tribe categorizations and Community results reflect the perceptions of individual users and may be subjective, incomplete, inaccurate, or uncomfortable. We do not endorse a categorization as a factual statement about the person being categorized.

We do not guarantee the identity, intentions, behavior, compatibility, or reliability of any user, and we do not guarantee that a user will receive a match or have a positive interaction off platform. To the extent permitted by applicable law, the service is provided on an "as available" basis. Nothing in these Terms limits rights or remedies that cannot lawfully be excluded.

To the extent permitted by applicable law, Neu Outsource UG (haftungsbeschränkt) & Co. KG is not responsible for losses caused solely by the independent conduct of another user or by activity on third-party services outside TRIBES. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

14. Governing Law, Changes and Contact

These Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer protections that apply regardless of that choice. Nothing in these Terms removes a user's right to bring a claim before a court available under applicable law.

We may update these Terms when the service, legal requirements, safety rules, or organizational arrangements change. Material changes will be communicated through an appropriate channel as required by applicable law. Continued use after an updated version takes effect may be subject to any acceptance requirements that apply in the relevant jurisdiction.
